This website is operated by Cigala Cycling Limited. Throughout the site, the terms “we”, “us” and “our” refer to Cigala Cycling. Cigala Cycling Limited offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

Credit card information is always encrypted during transfer over networks.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Across our websites with our domain, it is prohibited to users from recording and extracting sensitive data and give them to their collaborators without our permission. This includes the screening and recording with automated programs, software, bot, or any other method of screen scraping.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Cigala Cycling Retail, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Cigala Cycling Limited and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 16 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 17 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 18 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
SECTION 19 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of 6 Blackthorn Close, Wicklow Town, Co. Wicklow, A67 EH51, Ireland.
SECTION 20 - GIFT CARDS
Vouchers are for online use only, codes should be entered into the 'e-voucher' field in the basket online. They can't be redeemed against a telephone order, sorry.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
SECTION 22 - FREE MONTH COACHING OFFERS
Offers such as 1 Month Free Coaching when purchasing a power meter are not legible for Cigala Cycling coaching riders, as those already avails of discount that can be used on all items all year-round.
SECTION 23 - BICYCLE DELIVERY
Please note that we only operate online and do not have a physical store and/or workshop. All bike are delivered to the address supplied and no collection is available. Even though full bikes are delivered built, some small assembly might be required.
SECTION 24 - PAYMENT METHODS
We offer multiple payment methods at checkout including credit or debit cards, PayPal as well as finance options with Humm & Klarna.
A bank transfer option is also available for b2b customers.

SECTION 26 - RETURNS
- After your return is processed, you’ll receive a refund within 3 working days on the original payment method used. For more info, read our refund policy below.
- Sometimes, the Track & Trace information shows we’ve received your return, but you haven’t received an email confirmation yet. We strive to process your return within 48 hours. This excludes Saturdays and Sundays.
- We cannot accept returned products with visible traces of usage, missing parts or a missing / damaged original packaging. In these cases, we’ll send the product back to you.
Holidays return policy
During the festive season we have an extended returns policy. You now have up until 31 January to return orders placed between 1 and 24 December, so you don't have to worry about being able to return items that aren't exactly what you wanted. You'll receive a refund via the original payment method.
Please note: The extended returns policy only applies to products that are unused and still in their original packaging. Products with a '30 day satisfaction guarantee' label or a 'guaranteed fit' label that have been tested or tried out unfortunately do not fall under the extended returns policy -the normal 30 day return period applies to these products.
Conditions & exceptions

Conditions:
- All goods must be unused, unopened, inactivated, in a saleable condition and in their original packaging with all labels still attached.
- Returning an item is possible up until 30 days from the date mentioned on the purchase invoice;
- The product is complete, unused, undamaged and in the original packaging;
- When the return concerns a combined deal or a bundled product, it’s only possible to return the complete combined deal or bundle.
Exceptions which cannot be returned:
- Items or products with signs of usage or mounting;
- Products that have been opened or unsealed
- Items or products with missing or damaged original packaging;
- Products with software of which the seal has been broken;
- GPS devices that have been registered or used;
- Clothing that has been washed or shows signs of use;
- Products that cannot be returned for health or hygiene reasons;
- Products that have been registered to your name
- Products that are clearly personal in nature;
- Products that spoil or age quickly;
- Products that are custom made for you, ordered on demand, not in stock and pre-ordered on your request; products or a variant of a product that are not on our site and specially ordered from the manufacturer for you.
- Products returned in an unsatisfactory condition;
Refunds (if applicable)
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
Late or missing refunds (if applicable)
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.
If you’ve done all of this and you still have not received your refund yet, please contact us at retail@cigalacycling.com.
Exchanges (if applicable)
We do not exchange products. We want to ensure you receive a product as quickly as possible. To make this possible, you can instead return a product and place a new order for the right product immediately.
You’ll get a refund for the returned item within 3 working days after we’ve received and processed your return.
Delays and Non-delivery.
Date quoted for delivery is an estimate only;
In the event Buyer contests delivery, buyer must request a proof of delivery from seller within ninety (90) days of the date of order, otherwise delivery shall be deemed completed. Claims received beyond this period will be refused.
In the event that buyer fails/refuses to take delivery, Cigala Cycling Ltd will deliver back the goods in consignment at Buyer's costs and expenses.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
Depending on where you live, the time it may take for your exchanged product to reach you, may vary.
You must consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
Please note that for faulty goods we will arrange the shipment back to us.
However, please also note that packages, during shipping, might get damaged due to nature outside our control or even the courier control (road conditions, weather, warehousing conditions, handling, human error).
When receiving a package, and signing off to the courier the receival of the package you automatically accept the conditions.
If you realise afterwards that the product inside the package is damaged, please notify us a soon as possible so that we can get in touch with the courier. This should be done no later than 14 days from the delivery date since most courier companies have this maximum window to make any claims.
However, please note the if only the outside box is damaged and the product is in immaculate conditions, couriers nor ourselves take responsibility once the box has been accepted and signed during delivery.
Canceling an order

Please note that we pride ourselves on our quick turnaround time, this does mean there is only a small window to cancel your order. If you notice a mistake please cancel as soon as possible to avoid disappointment.
Although we will try our best to assist you we cannot guarantee we will be able to stop your order in time to prevent it from being dispatched.
Orders that have already been processed and dispatched can be canceled within 14 days of being received and must then be returned to Cigala Cycling Retail within a further 14 days as per your consumer rights.
You have rights under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 which state that up to 14 days after receiving your goods, in most cases, you can change your mind and get a full refund. You have the right to cancel this contract within 14 days from delivery without giving any reason. This right does not apply to any customised or personalised goods bought through our website. To exercise this right please contact us prior to the expiry of the cancellation rights period.
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). However, you are responsible for paying the return delivery charges.
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
We will make the reimbursement without undue delay, and not later than:
14 days after the day we received back from you any goods supplied; or
(if earlier) 14 days after the day you provide evidence that you have returned the goods; or
if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
Once the order has been canceled you will receive a confirmation email. If not dispatched orders that have been paid at checkout will be automatically refunded, any other payment methods would not have been charged so would not be due a refund. Orders that have been dispatched will be refunded at the point the good are received back with us. Unfortunately orders that have been canceled cannot be reactivated, so if you change your mind, please place a new order in the usual way.
The item must be:
-In saleable and undamaged condition;
-In its original unopened and sealed packaging; and
This policy is in addition to, and is not intended to limit, any rights or remedies you may have under the Consumer Guarantees Act.
This policy does not impact your rights where a product may be faulty, damaged, or incorrectly supplied. If an item is faulty/damaged/incorrectly supplied, we will meet our obligations under the Consumer Guarantees Act to provide a remedy.
Cigala Cycling is a retailer, not a wholesaler. Our aim is to inspire everybody, every day and everywhere to experience the joy of sport, not to act as a wholesaler supporting B2B sales. As such, we reserve the right to cancel excessive orders of individual products without notice. Please contact customer service for further information on this matter.
Pre-order policy
When you place a pre-order with us, we contact the appropriate distributor and place the order. If the item is available, we will then get order confirmation which we then confirm with you, along with the ETA. At this point, we have committed to the pre-order and can no longer cancel the item without penalty. Therefore, please be very sure when placing your pre-order as there are cancellation fees incurred if you change your mind. The cancellation fee for a pre-order is equal to 30% of the total amount, which for some orders of large amounts such as bikes, that is the non-refundable deposit that is required when placing the pre-order.
Estimated Time of Arrival (ETA)
ETA's can vary and are not guaranteed arrival date. We list the date given by manufacturer, but delays can and do happen. We cannot cancel your pre-order, even if delays are substantial, so please take this into account when ordering. We regularly update the product listing with the latest ETA. Keep an eye on the listings after you order to see when your product is due to arrive.
Settling a Pre-Order When It Arrives
When your item arrives we will contact you to settle any balance due and arrange shipping.
Orders must be settled within 7 days of the product coming into stock. Failure to settle within this period may mean you lose your pre-ordered item.
Prices quoted can be subject to change as items are only billed by manufacturers when they ship to us. We do everything we can to give you an accurate buy price, but pre-orders that are far away can vary in price if exchange rate varies from now until then.
Postage fees can also vary depending on the size of the product, type of shipping and number of boxes required. We suggest you pre-order each item individually as that way each pre-order's postage is paid separately and can ship as it comes into stock.
KICKR BIKE Return Terms & Conditions
Because of the size and weight of the KICKR BIKE, when returning KICKR BIKE (New, inactivated) due to changing your mind, you will be charged a restocking fee of €225. This fee is inclusive of the costs associated with any packing material to secure the KICKR BIKE for return shipment. You will be responsible for paying for your own shipping costs for returning the item.
REFUND/CANCELLATION POLICY CYCLING HOLIDAYS

Should you need to cancel your trip, please inform us by emailing us at travel@cigalacycling.com
When booking your trip, a deposit is collected. Deposits for cycling holidays are not refundable.
Balances are collected 31 days from the departure date, and are subject to the following cancellation policy:

For cancellations made between the deposit date and 31 days prior departure, a full credit of your balance (not including the initial deposit) will be carried forward for a future trip, to be used within two years.

For cancellations made fewer than 31 days before the trip no refunds can be issued. For this reason, we highly recommend travel insurance.
Credits can be used towards a new balance only. A new deposit will be required for each new booking.

Less than €100:
€5.95 with Standard Courier Tracked Service (1-3 business days) or €9.95 with Express Courier Tracked Service (1-3 business days).

The flat rate covers only the shipping cost and does not include duties, taxes, or other import charges levied by the importing country.
Our advertised price found on our site is the same across each country and represent either our own price, the RRP or the MAP price set by manufacturer.

For non Eu Countries countries Cigala Cycling Ltd is not liable for any local import duties and taxes.
Import duty and tax may be applied by local customs authorities. It is a legal requirement that we declare the full transaction value of the contents of all packages. Local import duties and taxes are levied by the carrier on behalf of the local customs authorities.
The payment of duties and taxes are the responsibility of the receiver.
If a package is not picked up, and the package is received back to us, the receiver will be charged for the return shipping costs (in full, based on our carrier rates) plus any duties and import taxes (if they are due).

SECTION 27 - CYCLING HOLIDAYS
1. Booking
With sending the booking form you are making an offer to enter into a contract with us. You may use our electronic form, or email it to us. By sending you the booking confirmation we are accepting your offer and therefore there is a binding contract between us.
With acceptance we send you a written confirmation including the first invoice covering the deposit.
2. Payment & Cancellation
Should you need to cancel your trip, please inform us by emailing us at travel@cigalacycling.com
When booking your trip, a deposit is collected. Deposits for cycling holidays are not refundable.
Balances are collected 31 days from the departure date, and are subject to the following cancellation policy:
For cancellations made between the deposit date and 31 days prior departure, a full credit of your balance (not including the initial deposit) will be carried forward for a future trip, to be used within two years.
For cancellations made fewer than 31 days before the trip no refunds can be issued. For this reason, we highly recommend travel insurance.
Credits can be used towards a new balance only. A new deposit will be required for each new booking.
3. Health requirements
We describe our holidays as 'active' holidays because we cycle between 30km and 150km a day and between 300 and 3,000metres ascent. You are responsible for being suitably fit and healthy. Nevertheless we ask you to inform us in advance of any physical conditions or disabilities that could endanger you or other participants.
4. Insurance
We advise you to take out comprehensive health, bicycle and travel insurance, including sufficient coverage for repatriation and additional hospital and medical expenses. Thus we strongly recommend that you review your health and personal insurance to meet the needs of you and your family in case of any loss of property, accident or injury during the trip. Cigala Cycling Limited are not liable for any fatalities, injuries, accidents, loss of belongings or damage to bicycles while on the tour or in transit.
5. Photography
By participating in a Cigala Cycling Tour, you are consenting to use of all photography and video taken on the tour to be used in future promotions and advertising. If for any reason you do not wish your image to be used in future promotions or advertising, you must put a request in writing before the tour starts.
6. Accommodation
All prices shown are for accommodation sharing with one other rider. (Twin room). If you require single occupancy, there will be an extra cost. We will do our best to accommodate riders who wish to have single occupancy but it is not always available.
7. Itinerary
The extent of our services is described in every online tour description, which you can also print out. The itinerary may be altered at any time by Cigala Cycling Limited as local conditions demand (e.g. weather, changed opening hours, changed ferry schedules). We shall inform you in advance in such an event.
Furthermore we shall not be liable for any drawbacks as the result of unusual and unforeseeable circumstances beyond our control such as strikes, war, civil or political unrest, border closure, quarantine restrictions, government actions or what is usually known as 'force majeure'.
8. Bike rental.
The equipment supplied, including all accessories, is provided on a hire basis. The hirer undertakes not to misuse the equipment and to return it with all accessories. The hirer agrees to use the lock provided and to lock the bicycle to an immoveable object every time the hirer is not with the bicycle.
7. Final clause
If any one of these terms and conditions should be or become ineffective it shall not affect the validity of the other terms and conditions nor the contract as a whole.
